Apple Pie Propaganda? The Smith–Mundt Act Before and After the Repeal of the Domestic Dissemination Ban
For over sixty years, the Smith–Mundt Act prohibited the U.S. Department of State and the Broadcasting Board of Governors (BBG) from disseminating government-produced programming within the United States over fears that these agencies would “propagandize” the American people.

What is the history of the Smith-Mundt act? Why did congress pass a law banning domestic audiences from hearing material intended for foreign audiences?
If you are at an institution with free access to legal databases, you can get greater depth from the legislative records cited below, but here is what I could dig up from free sources: The initial 1948 law provides that: [USIA publications] shall not be disseminated within the United States, its territories, or possessions, but, on request, shall be available in the English language at the agency, at all reasonable times following its release as information abroad, for examination only by representatives of the United States press associations, newspapers, magazines, radio systems, and stations, and by research students and scholars, and, on request, shall be made available for examination only to members of Congress. The prohibition was strengthened in 1972, and here is what the Court of Appeals for the D.C. Circuit has to say about the amendment: Particularly enlightening are the circumstances surrounding the 1972 amendment which first made the domestic distribution ban explicit. A member of the United States Senate had requested and obtained a USIA film which he intended to broadcast to his constituents. In direct response to the proposed broadcast, the Congress amended the Act to prohibit dissemination and distribution generally and to restrict its own members' access to USIA materials to "examination only." Essential Information v. USIA, 134 F.3d 1165, 1167 (D.C. Cir. 1998) (citing Senate Report 92-754 and 1972 House Report No. 1145). The prohibition was also strengthened in 1985, and here is what the amendment sponsor Sen. Edward Zorinsky said at the time: By law, the USIA cannot engage in domestic propaganda. This distinguishes us, as a free society, from the Soviet Union where domestic propaganda is a principal government activity. ... The American taxpayer certainly does not need or want his tax dollars used to support U.S. Government propaganda directed at him or her. Our amendment insures that this will not occur. Gartner v. US Information Agency, 726 F. Supp. 1183, 1186 n.2 (S.D. Iowa 1989) (quoting 131 Cong. Rec. 14945 (June 7, 1985)). More on reddit.com

Do you think the current political landscape in American is nearing a new era?
Remember, this is a civilized space for discussion. To ensure this, we have very strict rules. To promote high-quality discussions, we suggest the Socratic Method , which is briefly as follows: Ask Questions to Clarify: When responding, start with questions that clarify the original poster's position. Example: "Can you explain what you mean by 'economic justice'?" Define Key Terms: Use questions to define key terms and concepts. Example: "How do you define 'freedom' in this context?" Probe Assumptions: Challenge underlying assumptions with thoughtful questions. Example: "What assumptions are you making about human nature?" Seek Evidence: Ask for evidence and examples to support claims. Example: "Can you provide an example of when this policy has worked?" Explore Implications: Use questions to explore the consequences of an argument. Example: "What might be the long-term effects of this policy?" Engage in Dialogue: Focus on mutual understanding rather than winning an argument. I am a bot, and this action was performed automatically. May 10, 2025 -

I just had an infuriating discussion in public that spun me up for the first time in ages.

But the important thing was, he tried to cite a legislative act that Obama signed in like 2012. He insisted it allowed and encouraged the news to lie to the public.

Im sure thats twisted beyond any reality it may contain, but don't have a moment today to research it.

Anyone know what he was talking about? Im going to come back to it later.

There is a lot of confusion about Smith Mundt, but this is a wild one. I wish I could still generate surprise, but that part of me has retired, I think. Anyway, the Smith Mundt Act is another name for the US Information and Exchange Act of 1948, which was developed in the process of dissolving the Office of War Information and absorbing those resources into the State Department. It was signed into law by Truman, but it was as a Republican sponsored bill (Karl Mundt, South Dakota, he was a member of HUAC 😠 but also tried to get HUAC to investigate the KKK after they wrapped up in Hollywood 🙌 wonder what a world in which that had been successful might look like, ANYWAY I'm off track) The purpose was to allow the State Department to disseminate "public diplomacy information" (alternate word choice: propaganda) to foreign audiences (because Cold War), specifically prohibiting that same information being disseminated domestically (because the Third Reich). In 1972 this was amended, prohibiting all domestic access to the information intended for foreign audiences. This is one of the 3 key restrictions involved in the act, and the only one that was affected in the Obama era Modernization (which was also introduced by the red team - Rep. Mac Thornberry, TX) when, as part of the wider National Defense Authorization Act of 2013, the prohibition on domestic access was lifted, because it was both weird (the US was the only country that banned its own citizens from accessing the content their taxes were creating and distributing in other countries) and useless (because The Internet). The other 2 provisions of the Act remain unaltered - that information activities must maximize the use of private sector leaders to review + advise, and that these information activities should only be conducted where private agencies are lacking (ie they focus on areas with limited press freedom +/or distribution) and that the State Department cannot have a monopoly in any "medium of information". The most important piece that gets overlooked is that the provisions of this act have only ever applied to the State Department, and by extension the United States Information Agency (US propaganda department from post war - end of the nineties) which birthed, and then was replaced by, the Broadcasting Board of Governors which transitioned to the United States Agency for Global Media in 2018 and is now on death row via Executive Order, as of this past March. The other main thing the Modernization Act did in 2012 was add specific language clarifying that none of this applies to ("legal") intelligence operations. So, the DoD (+ NSA), the executive branch (+ CIA), and the DoJ (+ FBI) are not and never have been under jurisdiction of the Smith Mundt Act.  The properties (/"propaganda") covered by the Act include Voice of America, Radio Free Europe/Asia/Radio Liberty and Open Technology Fund. A lot of the misinformation stems from a BuzzFeed article quoting an unnamed source stating this would allow "US propaganda intended to influence foreign audiences to be used on the domestic population" which is just...not true, to the point where my conspiracy brain wakes up and sees a planted piece of disinformation. (The journalist, Michael Hastings, was critical of Obama but more from the left - he was known for a takedown interview with a VIP general, and also reported on the DoHS surveillance of Occupy. He died in what some people consider a suspicious car wreck in LA, at age 33, during what might have been a manic episode or might have been legitimate fear based on a sensitive investigation he had underway.) Hilariously, probably the clearest read for why the Modernization Act was a good thing, comes from the Heritage Foundation - it's about increasing transparency, and removing unnecessary government restrictions on free information. The Act still prohibits the State Department from creating material designed for domestic audiences, and still doesn't prohibit any US governmental agency that is not the State Department, from targeting US citizens with propaganda. I'm on mobile, this is mostly from notes I was writing about something else, but I can drop some links in later when I'm at a computer. There's a Pew Research explainer from 2012 that I would have to dig up but is pretty good, iirc.
