Why would the eb5 application be rejected and can one reapply ? Is there any grace time to switch to another visa, etc ?
Also Canada might not be a permanent solution but could be a good temporary one, especially if you’re around NY. A lot of people I know who had visa issues were able to get a work visa in Canada and continue working for us remotely. So should the worst happen, you can have a safety net without having to uproot your entire life

Are there successful EB-5 stories? Definitely.
Treat the EB-5 decision like any other investment decision.
Have clear goals. The green card is the real ROI. Imagine you have the green card and get the $800k back in 4-6 years. If that's not good enough and if you want 5-7-10% ROI on top of that, then you are probably setting yourself up for trouble.
Work in a regulated environment. An advisor who is answerable to SEC and FINRA is preferable to somebody who is regulated just by the USCIS.
Work with professionals who won't hesitate to say no. High returns plus return of capital in 3 years plus fee waiver plus.. plus.. plus..be wary of deals that sound too good to be true.
EB-5 projects offer risk-adjusted returns, which means high returns will definitely involve higher-than average risk. Why put your $800k at risk to earn 3-5% more? Instead, get the green card and check out high-risk high-return investments after you and your family are in the US as permanent residents.
Don't be penny wise and pound foolish. Ask yourself- is it wise to take a $800k decision based on a $20k fee waiver? A good project setup by a strong RC with good credentials is offering a fee waiver- Sure, why not? But not otherwise.
My boss likes to reiterate- "If a RC is ready to bend rule for you, then they are likely to bend the rules against you too." Better to stick to those who are ready to lose a deal rather than break the rules. Avoid those who are ready to agree to anything as long as they can close the deal and get your money.
Finally, ask your consultant to share references of success stories. Trust, but verify. A veteran immigration lawyer I have worked with likes to say- Your money, Your risk. Your decision.
