'Seditious Six' unlikely to face punishment, say law experts - Washington Times
November 29, 2025 - Military law professionals say President Trump’s administration likely has no criminal charges available to use against the six Democratic lawmakers who, in an online video this month, told service members to refuse illegal orders from the commander in chief. The experts did caution that Sen. Mark Kelly, Arizona Democrat, could be penalized, although probably not. The responses come after Mr. Trump and Secretary of War Pete Hegseth labeled the group the “Seditious Six” and the president suggested last week in a Truth Social post that they were “traitors to our country” and “should be arrested and put on trial.” · “Their words cannot be allowed to stand — We won’t have a Country anymore!!! An example must be set,” the president posted. Eugene Fidell, who teaches military justice at Yale Law School, says not so fast. He slapped the president’s shot as ...

Experts Say Democratic Video Not 'Seditious,' as Trump Claims - FactCheck.org
November 25, 2025 - After six congressional Democrats released a video advising members of the U.S. military and national security community to “refuse illegal orders,” President Donald Trump said the lawmakers should be tried in court for “SEDITIOUS BEHAVIOR, punishable by DEATH!” But legal experts told us this was not sedition and that the legislators were restating the law that only lawful orders must be followed.

News Analysis: Courts Begin To Push Back on Trump Amid Unprecedented Wave of 233 Court Challenges | Pulitzer Center
March 27, 2026 - Presidential advisor Stephen Miller had characterized the Democrats’ video as a call for “insurrection” and as a “general call for rebellion.” Trump had referred to it as “SEDITIOUS BEHAVIOR AT THE HIGHEST LEVEL,” called for jailing the members of Congress and suggested that their offenses were “punishable by DEATH.” Secretary Hegseth had referred to the six members of Congress as the “Seditious Six.” In a letter of reprimand, Hegseth said Kelly’s comments “undermined the chain of command; counseled disobedience; created confusion about duty; brought discredit upon the armed forces; and engaged in conduct unbecoming an officer.”

US government fails to secure charges against Democrats in 'illegal orders' video
February 11, 2026 - US federal prosecutors have failed to secure an indictment against six members of Congress who published a video last year encouraging US troops to disobey orders they deem illegal. A grand jury declined to indict the Democratic lawmakers on charges of seditious conspiracy in the case pursued by the office of the US attorney for the District of Columbia, Jeanine Pirro, who was nominated to the position by President Donald Trump.

'Seditious Six' Should Be Prosecuted For Urging Military Rebellion
November 26, 2025 - On Monday, the Department of War announced its commencement of an investigation into Sen. Mark Kelly, D-Ariz., for potential violations of the Uniform Code of Military Justice related to his participation in Democrats’ seditious “disobey unlawful orders” video. This is absolutely the right approach, and the move is a helpful contrast to the mixed bag Rep. Michael McCaul, R-Texas, offered this past Sunday on ABC’s This Week. When asked about President Donald Trump’s pushback against sitting Democrat lawmakers actively encouraging the military to disobey orders (specifically ones to destroy drug-running Venezuelan boats), McCaul was 100 percent correct that the orders are perfectly legal under Article II and that the White House needs to emphasize this fact. I would add to that and say that it needs to be hammered that these orders were issued to save American lives.
