WTF is a Sunset Clause | Music Industry Explained
I’m a music and entertainment attorney, but I’m not your or anyone else’s attorney on any matter, including this matter, and nothing I say here or elsewhere is, or should be considered legal advice, nor does it create an attorney-client or any other type of relationship between you or anyone else and me or any firm(s) I work for or own, unless and until we enter into a written attorney-client agreement in the future. This is and should be considered information and not legal or any other advice. You should always seek out and hire your own attorney for advice on your particular situation. A sunset clause is a clause that details what happens after a deal (or at least after the primary services/obligations, but not necessarily all of the obligations in the deal,) has ended or been completed. This is commonly (but not only,) used in artist management deals. For example, a sunset clause will state that after the term (completion) of the manager’s duties, the manager will still be paid additional commissions from the artist after the deal expires or terminates. In an artist management deal, ideally the commission % is lower than what the manager received during the deal, and for a shorter period of time than the deal lasted, and limited to only activities the manager was involved with prior to the deal’s conclusion. Sunset clauses exist in plenty of other types of deals, in music, entertainment, and even many other unrelated industries, though they might not be referred to specifically as sunset clauses like they frequently are in music or entertainment deals, however the purpose and impact is the same. What is a Sunset clause? Impacts?
A sunset-funded position means that the funding to pay the position's salary isn't permanent. This has two main impacts: The time worked in the position will not count toward a rollover to an indeterminate position after three years under the Directive on Term Employment . The chances that the job will become indeterminate through other means are effectively zero. That's about it, though - the pay and benefits are the same as any other term position, and you can still apply for internal jobs just like any other appointed employee. I'm not sure what you mean by having to "redo" probation. Probation periods don't restart unless somebody leaves and then re-joins the public service. A move from a sunset-funded term position to another term or indeterminate position has no impact on probation. If the probation period hasn't been completed, it simply continues into the new position. More on reddit.com
Is this normal to have in a Manager’s contract ? (the clause)
Sunset clauses are not uncommon for music and acting contracts when managers sign on developmental talent (an artist who has potential but has little professional credits). It’s to safeguard that they get compensated for the work they put in for their client when they’re basically an unknown, when the commissions for the first few years are relatively low. I myself signed a sunset clause with my manager, because I had no previous access to network auditions before. I thought it was worth it, and I still do, except my contract stipulates it only kicks in if I leave the management, not if they drop me. I think the details can be negotiated, though that might require running it by an entertainment lawyer. But it isn’t abnormal or a scam. More on reddit.com
